1. What information do we collect?
We may collect personal information that you provide to us by, for example, signing up for an account or using the contact form on any of our Services. Specifically, we may collect:
- Your name
- Your company’s name and your job title
- Contact information (such as your address, phone number, email address, and social media)
- Any other information you choose to provide
The Services may also collect some non-personal information about you automatically, such as:
- Your IP address and geographic location
- The date and time you access our Services
- The URLs of websites and pages you visit
- Hardware and software information that we receive from your internet-enabled device
- Device ID/Interaction Information, which refers to a unique identification number given to hardware components or devices that are connected to your computer or network. Interaction Information refers to the data that is collected when a user interacts with a device or application. This data can include information such as the user’s location, device type, and usage patterns
We may collect, process, and store your user identification associated with any social media account (e.g., Google™, LinkedIn™, Facebook™, Twitter™) that you use to sign in to the Services or connect with or use with the Services. When you sign in to your account with your social media account information, or otherwise connect to your social media account with the Services, you consent to our collection, storage, and use, in accordance with this Privacy Policy, of the information that you choose to make available to us through the social media interface. This could include, without limitation, any information that you have made public in connection with your social media account, information that the social media service shares with us, or information that is disclosed as being shared during the sign-in process. We may also obtain information about you if it is contained in user-generated content that you or other users post to or on the Services or another website. 2. Why do we collect, store, and process your information?

3. Data Collection Methods
Device ID/Interaction Information or Personal Information may be collected through the use of the following technologies:

- Web Tags. Small graphic images or other web programming code (also known as web beacons or pixel tags or 1x1 GIFs or clear GIFs) may be included in our web pages and email messages. These and similar technologies may be used for a number of purposes, including to count visitors to the Services, to monitor how users navigate Services, to count how many of our email messages were opened, or to count how many particular products were viewed. The information we collect through this technology may include the first date and time you open our email, and whether you click any links included in our email.
- Data Collection Through Mobile Devices. We use embedded scripts and similar tools to collect information from mobile devices such as the hardware model, operating system and version, identification numbers assigned to your mobile device, such as the ID for Advertising (IDFA) on Apple devices, and the Advertising ID on Android devices, mobile network information, and website usage behavior.
- Embedded Scripts. An embedded script is programming code that is designed to collect information about your interactions with the Services, such as the links you click on. The code is temporarily used by our server or a third-party service provider or business partner while you browse or interact with the Services and is deactivated or deleted when you disconnect from the Services.
- Other Methods of Collecting Data. In addition, we may use a variety of other technologies that collect similar device and device interaction information for security, fraud detection, and maintenance purposes.
- De-identifying and Pseudonymizing Personal Data. Note that we may de-identify or pseudonymize your personal data so as to make it non-personal, either by combining it with data about other individuals and/or by hashing the data or otherwise removing characteristics that make the data personally identifiable to you. We will treat de-identified or pseudonymized data as non-personal to the fullest extent allowed by applicable law. We maintain and use de-identified data without attempting to re-identify it, except where permitted by applicable law, such as to determine whether our de-identification processes satisfy legal requirements. If we combine non-personal data with personal data, then we will treat the combined information as personal data under this Privacy Policy. We may share non-personal data with third parties for any purpose in our discretion and as permitted by law, including for advertising, research, and marketing purposes. 4. Data You Provide Directly
We may ask you to provide data to us when you use the Services, for example in the following ways:
- Live Chat. The Company Service Chat can record, use, and retain your information provided, as well as the communications within the chat, for purposes of assisting you during the conversation, provide related support for your services, to improve our products and Services, and marketing purposes. If you do not consent, please do not use the chat assistance feature.
- Photos and Videos.We allow you to post photos and videos on the Services or to submit them to us as described in the chart above. Applicable laws and regulations may vary with respect to whether such materials are considered to be biometric information. For clarity, Outdoor Living Way does not create a record of facial geometry from your photos or videos and does not use your photos or videos for the purposes of facial recognition, facial surveillance, or otherwise as a biometric identifier. Please note, however, that to the extent that you post your photos or videos publicly on the Services, or we share - as described elsewhere in this Privacy Policy - such materials with third parties who are permitted to use these materials in accordance with their own privacy policies, we do not control the actions of third parties, and their use of your photos or videos may differ from ours.
5. Disclosures to Third Parties
We may share non-personal information, such as certain Device ID/Interaction Information, hashed or otherwise de-identified or pseudonymized data, and aggregated user statistics, with third parties in our discretion and as permitted by law, including for targeted advertising purposes. We may share the information we have collected about you (including personal information) in the circumstances described below or elsewhere in this Privacy Policy, as disclosed at the time you provide information or otherwise with your consent. However, we do not share personal information with unaffiliated third parties for their own marketing purposes without giving you the chance to consent (opt-in or, where permitted by law, opt-out). Please note that we are not responsible for the privacy practices of any third party. If you decide that you do not want to receive communications from a third party, or have questions about their privacy practices, you will need to contact that third party directly. We also disclose information to third parties as follows:
- Affiliates. We may share information among our affiliated corporate entities for their business purposes.
- Third Party Business Partners. We may share your personal information with third party business partners including unaffiliated third parties such as joint marketing partners for their own business and marketing uses. Such third party's use of the personal information is subject to their privacy policy and data practices.
- Third Party Service Providers Who Provide Services on Our Behalf. We may share information with third-party service providers or allow those third parties to collect information about you, to enable them to perform services on our behalf, such as website hosting, conducting website usage analytics, sending email, text, or other communications, fulfilling orders, providing marketing assistance and data analysis, processing payments, and other services. Additionally, we may share various information relating to our users and fraudulent or potentially fraudulent activities with our fraud prevention and similar service providers, and they will use this information to help us and their other clients prevent fraudulent and illegal transactions.
- Third parties to whom you agree or direct us to share your information. We may share your personal information when you expressly consent or otherwise direct us to do so. For example, if you consent to post a testimonial along with your name or if you choose to link your account with a social networking service, other third party application or feature through which information is shared, or if you purchase an extended warranty for any product and seek to register the warranty or exercise a claim, based on your direction, we may share your personal information with the extended warranty provider.
- Information You Disclose Publicly. The Company may provide you with forums and other public areas to post content including photos, videos, and promotion entries. Note that anything you choose to disclose in such areas is public and may be viewed, collected and used by members of the public and the protections of this Privacy Policy will not apply. Think carefully before you post and use caution before disclosing any personal information.
- Sweepstakes/Contest Partners. We may offer sweepstakes, contests, or other promotions (any of which, a Promotion) that may require registration. By participating in a Promotion, you are agreeing to the provisions, conditions, or official rules that govern the Promotion, which may contain specific requirements of you (including, except where prohibited by law, allowing the sponsor(s) of the Promotion to use your name, voice, likeness, or other indicia of persona in advertising or marketing materials). If you choose to enter a Promotion, personal information may be disclosed to third parties or the public in connection with the administration of such Promotion, including in connection with winner selection, prize fulfillment, as required by law, or as permitted by the Promotion's terms or official rules (such as on a winner's list).
- Social Media and Other Third-Party Platforms. We may host or facilitate interactions with social media or other third-party platforms, like Facebook, X (formerly Twitter), LinkedIn, YouTube, Pinterest, Google, or Apple. You may also have the opportunity to log in through or otherwise connect to your third-party platform account. When you interact with these third-party platforms through the Services, we will receive information about you from the third-party platform service and you will be choosing to share information about your interactions with the Company with that social media service. In addition, the third-party platform service may set their own cookies and collect information about your use of the Services, including your IP address or other device identifiers, and which pages you visit on the Services. These third-party platforms may be able to collect certain information on your visits to the Services regardless of whether or not you affirmatively interact with the feature and whether or not you are logged into (or have) an account with the third party platform. If you are logged out or do not have an account and visit a page with a social plug-in, your browser sends a more limited set of information. Like other sites, the third-party platform will receive information about the webpage you are visiting, the date and time of your visit, and other browser-related information. They may use that information to help them improve their products or for other purposes set forth in their privacy policy. We may also receive information about you if other users of social media give us access to their profiles and you are one of their connections or friends. The information we collect is subject to this Privacy Policy. The information collected and stored by the third party remains subject to the third party's privacy practices, including, without limitation, whether the third party continues to share information with us, the types of information shared, and your choices regarding what is visible to others on that third-party website or service. The third party may allow you to remove the application or feature, in which case we will no longer collect information about you through the application or feature but may retain the information previously collected. If you choose to post information to a third-party platform, that information may be public.
- Third Parties Who Acquire Information in Connection with a Business Transition. In the event the Company goes through a business transition, the Company reserves the right to disclose and transfer all personal information related to the Services (including, without limitation, during the course of any due diligence process): (i) to a subsequent owner, co-owner or operator of the Services; or (ii) in connection with a corporate merger, consolidation, restructuring, bankruptcy, the sale of certain of Company’s ownership interests, assets, or both, or other company change. By providing your information, you understand and agree that we may transfer such information to the acquiring entity without your further consent, except where required by law.
6. Third Party Advertising and Analytics, Privacy Controls, Do-Not-Track Policies
The Company works with third party business partners, including online advertising companies, ad agencies, and analytics providers to serve Company ads online, and to provide us with information regarding the use of the Services and the effectiveness of our advertisements. These third parties may set and access their own tracking technologies (like cookies and web tags) on your device, and they may otherwise collect or have access to Device ID/Interaction Information and other information about you, some of which may be personal data or personal information under various state laws. Some of these parties may collect personal data over time when you visit the Services or other online websites and services. We may share information, typically information that has been aggregated or de-identified, pseudonymized, Device ID/Interaction Information, and location information with third party advertising companies, analytics providers, and other third parties, including for the purpose of serving you more relevant ads on and off the Services.
If you would like to opt-out of third-party advertising and analytics, there are a variety of tools available to you:
- Cookie Opt-Out Tools. To disable sharing through cookies set on our site by third parties for advertising and analytics purposes, please adjust your cookie settings using the Manage My Cookies link in our website footer. Please see the Jurisdiction-Specific Rights Section below for additional rights individuals in certain jurisdictions may have.
- Do Not Track/GPC. Do Not Track (DNT) and Global Privacy Controls (GPC) offered by some web browsers are settings that automatically inform websites of your privacy preferences with regard to third party online tracking including exercising your rights and requesting the web application to disable tracking you. When you choose to turn on the DNT/GPC setting in your browser, your browser sends a special signal to websites, analytics companies, ad networks, plug in providers, and/or other web services you encounter while browsing to exercise your privacy rights and stop tracking your activity. There is no clear consensus on what it means to comply with these signals and we typically do not take additional steps in response to them, but we comply with DNT and GPC as specifically required under applicable law.
- NAI/DAA Opt-Out. Some of the companies we use may be members of the Network Advertising Initiative (NAI) or Digital Advertising Alliance (DAA). The NAI provides information regarding targeted advertising and the opt-out procedures of NAI members, including opt-out mechanisms for web browsers, mobile and other connected devices, and a tool to opt out from participating NAI members using your hashed email address for interest-based advertising. You may also want to visit the DAA's website, which provides information regarding targeted advertising and offers an opt-out for DAA-participating companies.
- Mobile Device. Mobile devices may contain settings that allow you to disable tracking advertising and/or analytics.
- Google Analytics/Adobe Analytics. We use Google Analytics and Adobe Analytics, which use cookies and similar technologies to collect and analyze information about the use of the Services and report on activities and trends. These services may also collect information about the use of other websites, apps, and online services. Please note that opting out through these mechanisms does not opt you out of being served advertising, and that you will continue to receive generic ads while online. Your opt-out choices are typically browser and device specific; if you disable your cookies, upgrade your browser after opting out or if you use multiple different devices, please opt-out on each device and each browser separately.
Opting Out to Email and Text Marketing. We may provide you with the option to update your information through the settings under your account. In addition, you may opt out of marketing communications as set forth below. If you are a resident of certain jurisdictions, you may also have the right to make choices about how we collect, use, and share or sell your personal information.
- Email. You may unsubscribe from marketing emails we send you through the opt-out mechanism included in each such email. Note, however, that we reserve the right to send you certain communications relating to your use of the Services, notices of changes to this Privacy Policy or other terms, or similar administrative and transactional messages.
- Text Messages. If you sign up to receive SMS, MMS, or RCS messages from one or more of our Services, you may unsubscribe by replying STOP to the short code.
7. Data Protection Methods
The Company has put technical and organizational safeguards in place to help prevent loss of or unauthorized access to the information we collect. - To create, tailor, deliver and study the effectiveness of advertising and promotional material both on and off of the Website, as well as for analytics (including as described in the Cookies section above)
- To improve the Website and the services offered thereon and to research and develop innovative features and new services
- To provide feedback to businesses listed on the Site
- If part or all the ownership of Company is sold or transferred, your information may be transferred to the new owner
- When disclosure is required by law, to investigate, prevent, or report unlawful or harmful activities, or violations of our Terms and Conditions, or to protect the rights, property, or personal safety of personnel of Company, or members of the public
The Company may anonymize and/or de-identify information collected through the Site or via other means so that the information no longer relates to you. Where we have appropriately anonymized and/or de-identified information so that it no longer identifies you personally, our use and disclosure of such information is not subject to this Privacy Policy and may be used and disclosed to others without restriction.
9. How long do we keep your information?
We may keep your information on file for the maximum period allowed by law, or indefinitely if there is no such period. If you are in the European Union or the United Kingdom, you have a right to, among other things, request that we delete your personal data.
10. Information from Children
Our Site and services are not directed to children, and you may not use our services if you are under the age of 18 years old. The Company will make a reasonable effort to notify the child's parent or guardian at the e-mail address provided by the prospective customer, alerting the parent or guardian to the child's use of the Site and providing instructions as to how the parent or guardian can delete the child's registration from the Site. The Company does not use personally identifying information collected from children for marketing or promotional purposes and does not disclose such information to any third party for any purpose whatsoever.
11. Lost or Stolen Information
If a customer's credit card and/or password is lost or stolen, the customer should promptly notify the Company in order to enable the Company to cancel the lost or stolen information and to update its records with a changed credit card and/or password.
12. Chat Rooms, Forums and Bulletin Boards
If customer participates in a Company chat room, discussion forum, bulletin board, or any other forum and posts messages, photos, or videos to such forum, the customer should be aware that the information disclosed and shared will be broadly available to other persons, both inside of and/or outside the Company, who have access to that chat room, forum or bulletin board. Some individual Company chat rooms, forums or bulletin boards have additional rules and conditions regarding participation. Also, participant's expressed opinion is his or her own and should not be considered as reflecting the opinion of Company. Note that anything you choose to disclose in such areas is public and may be viewed, collected, and used by members of the public and the protections of this Privacy Policy will not apply. Think carefully before you post and use caution before disclosing any personal information.
13. State Specific Privacy Disclosures
The Company describes the personal information that we collect, the sources from which we collect it, the purposes for which we use it, the limited circumstances under which we share personal information, and with whom we share it. Categories of personal information disclosed for a business purpose: The personal information that the Company disclosed to the third parties identified in the "Disclosures to Third Parties" section of the Company’s Privacy Notice falls into the following categories established by the California Privacy Rights Act, depending on which Company Service is used:
- Identifiers such as your name, address, phone numbers, IP address, or government identifier, for example if we use a third-party carrier to deliver your order, or if we use a third-party service to verify your identity, certain types of ID you provide for identity verification that may in some cases reflect your citizenship or immigration status.
- Personal information, such as a credit card number or other payment information, for example if we use a third-party payment processor.
- Information that may reveal age, gender, race, sexual orientation, or other protected classifications, for example if you choose to participate in a survey distributed by a survey provider.

- Inference data, for example if we use a service provider to help us optimize the accuracy of your shipping address to make sure your order reaches you.

Advertising: As explained in the "Third Party Advertising" section in our Privacy Notice, the Company shares limited information to help ensure you receive more useful and relevant Company ads and to measure their effectiveness. Any personal information we may have shared for the purpose of cross-context behavioral advertising, as that term is defined by the California Privacy Rights Act, in the twelve months prior to the effective date of this Disclosure falls into the following categories:
- Identifiers such as a cookie, a device identifier, or a code derived from applying irreversible cryptography to other information like an email address; we never share your name or other information that directly identifies you.
- Internet or other electronic network activity information, such as whether you downloaded an app or other measures of ad effectiveness; for example, if you have already downloaded one of our apps, we will share an advertising identifier and data about that event so that you will not be served an ad to download the app again.
- Inference data; while we do not share your specific shopping actions like purchases, product views, or searches with ad companies, we may share an advertising identifier and an estimate of the value of the ads they show you on our behalf so they can serve you with more effective Company ads.
The categories of third parties with whom the Company may share personal information for the purpose of cross-context behavioral advertising are identified in the “Disclosure to Third Parties” sections of this Privacy Notice. The Company also processes personal information for the purposes of targeted advertising as that term is defined under the Virginia Consumer Data Protection Act, Colorado Privacy Act, Connecticut Data Privacy Act, and Utah Consumer Privacy Act.
- Your Data Rights: You may have certain data rights under state privacy laws, including to request information about the collection of your personal information by the Company, to access your personal information in a portable format, and to correct or delete your personal information. - No sale of personal information. In the twelve months prior to the effective date of this Disclosure, the Company has not sold any personal information of consumers, as those terms are defined under the California Privacy Rights Act.
- California Privacy Rights Act Sensitive Personal Information Disclosure. The categories of data that the Company collects and discloses for a business purpose include "sensitive personal information" as defined under the California Privacy Rights Act. We do not use or disclose sensitive personal information for any purpose not expressly permitted by the California Privacy Rights Act.
- California Privacy Rights Act Retention Disclosure. We keep your personal information to enable your continued use of Company Services, for as long as it is required in order to fulfill the relevant purposes described in the this Privacy Notice, as permitted or as may be required by law, or as otherwise communicated to you. For example, we retain your transaction history so that you can review past purchases (and repeat orders if desired) and what addresses you have shipped orders to, and to improve the relevance of products and content we recommend.
- California Privacy Rights Act Non-discrimination Statement. We will not discriminate against any consumer for exercising their rights under the California Privacy Rights Act.
- No sale of personal information. In the twelve months prior to the effective date of this Disclosure, the Company has not sold any personal information of consumers, as those terms are defined under the California Privacy Rights Act.
- California Privacy Rights Act, Colorado Privacy Act, Connecticut Data Privacy Act, Utah Consumer Privacy Act, and Virginia Consumer Data Protection Act De-identified Data Disclosure. We may use de-identified data in some instances. We either maintain such data without attempting to re-identify it or treat such data as personal data subject to applicable law.
- Colorado Privacy Act Profiling Disclosure. We do not engage in profiling of consumers in furtherance of automated decisions that produce legal or similarly significant effects, as those terms are defined under the Colorado Privacy Act.
14. Your California Consumer Protection Act (“CCPA”) Personal Data Privacy Rights.
